2. Acceptance. By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

3. Who the Site is for. The Site is intended for people aged 18 or over acting on behalf of a business or professional activity. We do not knowingly collect data from anyone under 18.

4. What the Site does. The Site presents the services of Prisma & Data, lets you book a demo conversation, and lets you send a proposal request. The Site's content is informational. Nothing on the Site is a binding offer, a quote or a promise of results; prices, scope, timelines and commitments exist only in a proposal or contract signed by us and by you.

5. Booking and proposal requests. Booking runs on Cal.com and the proposal form on Formspree, each under its own terms. Sending a request or booking a conversation creates no obligation to contract for either side. You agree to provide accurate information and not to submit personal data of third parties without authorisation.

6. Intellectual property. The text, design, brand, the prism, the animations and the Prismax character belong to us or to our licensors. You may view the Site and share its links. You may not copy, reproduce, modify, distribute or automatically extract (scraping, non-search crawlers, scripts) any part of the Site without written permission.

7. Acceptable use. You must not: attempt to access non-public areas or systems; interfere with the Site's operation; submit unlawful, offensive or rights-infringing content; use the Site to send bulk or automated messages. We may restrict access for anyone who breaches these Terms.

8. Third-party services. The Site uses third-party services (Vercel hosting and audience statistics, the Formspree form, the Cal.com scheduler, Google for calendar and e-mail). We do not control them and are not responsible for their terms, availability or practices; links to their policies are in our Privacy Policy.

9. Availability and warranties. The Site is provided "as is". We make reasonable efforts to keep it available and accurate, but we do not warrant that it will be free of errors, interruptions or viruses, or that its content is always current.

10. Limitation of liability. To the fullest extent permitted by Brazilian law, we are not liable for indirect damages, lost profits or loss of data arising from use of, or inability to use, the Site. Nothing in these Terms excludes liability that cannot be excluded by law, including under the Brazilian Consumer Defence Code where it applies.

11. Changes. We may change these Terms at any time. The version in force is the one published on the Site, with the update date at the top. Continued use after publication means acceptance of the new version.

12. Language. These Terms are published in Portuguese and English. If they differ, the Portuguese version prevails.

13. Governing law and forum. These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the Judicial District of São Paulo, SP, are elected to resolve any dispute, to the exclusion of any other, except where the law grants a consumer the forum of their own domicile.
